Under what circumstances can the "burned" fees of SmartBCH be "unburned" ?

I think I read somewhere that the fees are not actually burned, but they can be accessible.

I want to learn the truth once and for all.

And also if there is a way to access the "burned" funds - does anyone have any doubt that it will eventually be taken. And what effect that will have on the reputation of BCH and similar such projects in the future.
